Terms and Conditions for the
immorenta Real Estate Platform

These Terms and Conditions set out the rules for using the real-estate platform at immorenta.me, which is operated by ekosphere doo under the laws of Montenegro. By accessing or using the Platform, you acknowledge and accept these Terms. If you sign a separate written brokerage and/or service agreement with us, that individual agreement will take precedence where there is any inconsistency.

Professional activity. We operate an online platform for real-estate listings alongside brokerage and consulting services. ekosphere doo maintains professional liability insurance in accordance with the Montenegrin Zakon o posredovanju u prometu i zakupu nepokretnosti.

Acceptance of the Terms and Conditions

By visiting, browsing or otherwise using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of them, you should discontinue use of the site and related services. Where you have entered into a written brokerage or service contract with us, that contract will override any conflicting provision contained in this document.

Definitions

“We”, “us” and “our” refer to ekosphere doo. “Platform” refers to this website and associated online services. “Listing” denotes any property-related information published on the Platform. “User” means any person or entity – including visitors, leads, sellers, landlords, buyers or tenants – who accesses or uses the Platform.

Nature of Service & No Advice

The Platform serves as an information and lead-generation environment for real-estate opportunities in Montenegro. The content provided does not constitute legal, tax, financial, engineering or architectural advice. Any decisions taken on the basis of information from the Platform are your own responsibility and should be supported by independent professional advisers and on-site inspections.

Unified listings database. All property data shown on this site is sourced from a unified listings database managed by ekosphere doo. The same core dataset is used across the following affiliated websites:

…as well as any subdomains under https://(subname).ekosphere.me. Minor deviations in timing or formatting between these sites may occur due to caching or synchronisation. In case of discrepancies, the content of the duly signed transaction documents is decisive.

Eligibility; Users from EU & US

You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform. Users are responsible for ensuring that their use complies with the laws of their respective jurisdiction. Consumers from the EU/EEA and visitors from the US may use the Platform; any mandatory consumer protection rules that apply to them remain intact.

Listings, Availability & Third-Party Content

  • Listings can originate from owners, developers or partner agencies. Information may change or contain inaccuracies (e.g. price, area, permits, availability, tax details, utilities, zoning, coastal/setback regulations, etc.).
  • Photos, floor plans and visualisations are for illustration purposes only. The definitive basis for a transaction is always the final, signed documentation.
  • Links to third-party websites are provided for convenience only; we do not control and are not responsible for the content or policies of such external sites.

Engagement, Fees & No Agency by Browsing

  • Mere use or browsing of the Platform does not establish an agency or brokerage relationship. A formal representation starts only once a written engagement in line with Montenegrin law has been signed.
  • Our fees and commissions are determined in the relevant engagement agreement and may, in accordance with applicable law, be borne by the buyer/tenant, the seller/landlord or shared between the parties.
  • Any transaction is subject to satisfactory due diligence, proof of funds, KYC/AML procedures and any other regulatory or bank requirements.

Accounts, Leads & Communications (incl. WhatsApp)

  • You are responsible for ensuring that your account details remain accurate and that your login credentials are kept confidential.
  • By submitting inquiry or contact forms, you consent to us reaching out to you via email, telephone and common messaging services (including WhatsApp). You may withdraw this consent at any time.
  • For compliance and quality assurance, we may record non-sensitive transaction metadata. Further details are outlined in our Privacy Policy.

Fair-Housing / Anti-Discrimination

We do not tolerate discrimination on any prohibited grounds. Our approach is intended to align with the principles of the US Fair Housing Act, applicable EU/EEA equality directives and relevant national legislation.

Acceptable Use

  • Automated scraping, bulk copying, data mining, reverse engineering or attempts to circumvent technical protections are not permitted.
  • You must not use the Platform for unlawful, defamatory, fraudulent, infringing or otherwise harmful purposes, nor introduce malware, spam or similar disruptive content.
  • Robots.txt directives and rate limits must be respected; in cases of abuse or suspected misuse, access may be limited or blocked.

Intellectual Property & License

The layout, branding, text, images (excluding third-party trademarks) and underlying code of the Platform are owned by ekosphere doo or used under license. You are granted a limited, revocable, non-transferable license to use the Platform for personal, non-commercial purposes. Any commercial or otherwise extensive use requires our prior written consent.

Notice & Takedown / DSA / DMCA

If you believe that content on the Platform is unlawful or infringes your rights, please notify us at office@immorenta.me, including the URL, a description of the issue, your contact details, the legal basis for your claim and a good-faith statement. We will act without undue delay in accordance with the EU Digital Services Act (DSA). For alleged copyright infringements affecting US rights holders, DMCA-style notices can be sent to the same address.

Privacy, Cookies & Geolocation

Details on how we process personal data, use cookies and potentially work with approximate geolocation are set out in our Privacy Policy and our Cookie Policy. You can restrict location access directly in your device or browser settings if you prefer.

Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted, secure or error-free operation of the Platform.

Limitation of Liability

To the maximum extent allowed by law, ekosphere doo and its staff shall not be liable for any indirect, incidental, special, consequential or punitive damages; loss of profit, data, goodwill; or business interruption resulting from your use of, or inability to use, the Platform. Any aggregate direct liability on our side is limited to EUR 100, or (if you have a signed engagement with us) to the total amount of fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, whichever is higher where mandatory law so requires.

Indemnity

You agree to indemnify and hold harmless ekosphere doo from and against any claims, damages, liabilities, costs and expenses arising from your breach of these Terms, unlawful use of the Platform or violation of third-party rights.

Force Majeure

We are not liable for any delay or failure to perform obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, government measures, power or network outages, strikes or pandemics.

Governing Law, Jurisdiction & Consumer Rights

  • Governing Law. These Terms are governed by the laws of Montenegro, excluding its conflict-of-laws rules.
  • Jurisdiction. The competent courts of Ulcinj, Montenegro, shall have jurisdiction. Mandatory EU consumer protection provisions remain unaffected.
  • ODR. EU consumers may use the European Commission’s online dispute resolution platform: ec.europa.eu/consumers/odr.
  • US visitors. Where legally permissible, you waive participation in class or representative actions against us. If such waiver is not enforceable, the remaining parts of these Terms shall continue to apply.

Changes to the Terms

We may amend these Terms and Conditions from time to time. The current version is the one published on the Platform with the corresponding “Last updated” date. Substantial changes will be reasonably highlighted or communicated.
